Recent legal & business developments in Belarus, November 2010
1) Documents on creation and operation in the Republic of Belarus of state institution “National agency of investments and privatization” are on the stage of coordination and may be adopted before the end of 2010. For creation of state institution “National agency of investments and privatization” the statute, regulation on relationship of agency with other state institutions and bodies and regulation on supervision board shall be approved. Those are three main documents, which have already been prepared and are being coordinated and approved. The agency will be dealing with complex maintenance of investors.
2) A procedure of acquisition of land plots for construction of tourist objects. It is planned to exclude a necessity to hold an auction in occasion of allotment of land plots for construction of objects of tourist infrastructure. This is provided in the draft of an edict, directed at development of entrance tourism in the Republic of Belarus. Such innovation will create more favorable conditions for businessmen, intending to invest in construction of objects of touristic infrastructure on the territory of the Republic of Belarus.

He also added, that companies, possessing license on execution of different types of construction works, will enter this register automatically. New organizations, will be obliged to pass procedure of confirmation of competence. “There will be a procedure of confirmation, that organization possesses employees, mechanisms, experience, personnel for fulfillment of specific kind of works, which it pretends to fulfill. Inclusion in the construction register will provide a right to perform this kind of activity on legal basis’ – explained the director of the department.
4) Almost all Belarusian banks, accepting payments, entered single settlement information space. 26 banks are connected to the system of settlement, 25 of them accept payments. 568 contracts were concluded with producers of services. Infrastructure of the system includes more than 7 000 of points of acceptance. That exceeds infrastructure of any Belarusian bank.
According to the head of main department of information technologies of the National Bank of the Republic of Belarus, Oleg Veremejchik, the project of the single settlement information space has analogs neither in the CIS, nor in the far-abroad states. “This example of serious cooperation not only of bank system of the Republic of Belarus, but also of developers of IT-decisions” – he explained.
5) The President of the Republic of Belarus expanded amount of persons, possessing right to realize mortgaged land plots and rights of lease on them. This decision is included in the Decree of the President of the Republic of Belarus No 9 from November 22, 2010, altering the Decree No 3 from March 1, 2010 “On certain issues of property mortgage”.
In accordance with Decree, such right can be used not only by banks – mortgagees, but also by other mortgagees: International Finance Corporation, European Bank for Reconstruction and Development/ In occasions, determined by the acts of President of the Republic of Belarus other organizations will also be vested in such right.
The Decree enters into force after its official publication and will be submitted for examination of the National Assembly of the Republic of Belarus.
